To make use of our services it is essential that you know and accept these General Terms and Conditions of Use for Payers (hereinafter "T&C") as they govern the relationship that THE MERCHANT has with you. We recommend that you read them carefully and that you print or save an electronic copy of them for later reference.
It is essential that as a Payer you refrain from accepting these T&C if you lack legal capacity to do so or are a minor. THE MERCHANT has no way of verifying that your acceptance is binding, so it will presume that it is.

1. GENERAL
1.1. These T&C govern the relationship under which THE MERCHANT provides this payment channel to its payers.

1.5. THE COMPANY may suspend or cancel your use of the Payment channel, at any time, if you fail to comply with the provisions of these T&C or make illegitimate or inappropriate use of the universal LINKPAGO Platform of THE MERCHANT.
1.6. The Payer agrees that all information entered is true, complete and correct. Which makes you responsible to THE TRADE and to third parties for inaccuracies, errors or falsehood in the exercise of the information you provide.
1.7. The Payer is responsible for maintaining adequate security and control of any identifications, passwords, personal identification numbers or any other code issued by banks for online transactions that You use to make the payment.
1.8. In cases of refund or cancellation, the customer must notify in writing within a period not exceeding 48 hours of having made the payment to THE MERCHANT. Any claim or cancellation must be notified directly to THE TRADE, after a longer time than indicated above no claims of any kind will be accepted.
1.9. For the use of our Portal, we may collect certain personal data from you because we receive it through you. The personal data obtained through the contracting and use of Services are treated based on these terms and conditions, and privacy clauses. The personal data that you enter in the Portal are considered at all times confidential and private information, attached to the terms that may be established by law.
CROEM COLOMBIA SAS, undertakes to use reasonable security measures to prevent the alteration, loss, destruction, theft and unauthorized treatment or access of your personal data.
2. DESCRIPTION OF THE SERVICE
2.1. The MERCHANT requests the payment service with Visa and MasterCard credit and debit cards or others, through the Universal LINKPAGO Platform, once affiliated to the service the customer has a redirection to the https://payments.merchantprocess.net/linkpago/identificación website of THE MERCHANT, which will be its payment page which will allow the payer to pay for the services or products offered by THE MERCHANT.
The Universal LINKPAGO platform complies with the security standards and regulations of the credit card industry.
The Universal LINKPAGO platform works as follows:
1. THE MERCHANT sends to the payer's email the description of the charges to be paid, within the body

THE MERCHANT must take all necessary measures to guarantee the veracity and authenticity of the payments received.
THE COMPANY undertakes to maintain the proper functioning of the Universal LINKPAGO Platform, it is forbidden to use the platform by third parties outside the account of THE COMMERCE.
THE MERCHANT is fully and exclusively responsible for the quality and guarantee of the goods and services sold to its customers using the LINPAGO universal platform (payment page), as well as to address complaints and claims regarding the products that may be presented.
3. PRODUCTS NOT ALLOWED – RESTRICTIONS ON USE
Certain businesses carry out activities considered risky or that require more specific knowledge about their type of business. The Universal LINKPAGO platform cannot be used to receive payments generated by the following activities (sale of products or services):
1.Adult content, child pornography or other activity related to illegal adult entertainment.

3. Alcoholic beverages
4. Sale and breeding of animals

2.Any product or service considered illegal
3. Telemarketing calls to solicit donations
4. Check cashing service
5.Colon cleansing and other detoxification products
6.Computer programs (e.g. antivirus) sold by means of deceptive advertising
7.Credit card debt/mortgage/interest reduction services and credit card protection.

10. Collection agencies
11. Diet pills or related products
12.Drug paraphernalia

15. Exporters of any type of foreclosure protection services

CROEM COLOMBIA SAS or THE ACQUIRING BANK of EL COMERCIO reserves the right to immediately interrupt the service to any affiliated business that is exercising any of these items, in addition to the immediate freezing of all funds without the possibility of any disbursement, including reserve, escrow deposits and any assets we have in possession. THE MERCHANT accepts this clause explicitly and irrevocably with the simple fact of making use of the platform. This includes both users and merchants.
4. LIMITATION OF LIABILITY
THE COMPANY does not assume any responsibility when any of the following situations occur:
a) Malfunction and/or abnormal operation, including null functioning, of the card processors' servers.
b) Defective and/or abnormal operation, including null functioning, of any intermediary involved in the process.
c) Loss of profits produced by any of points a and b above.
d) Termination, cancellation or nullity of the contract of THE BANK with THE COMPANY
e) Warranty, support, technical service, repair, compensation, replacement, shipping, claims, complaints, complaints of the goods and / or services sold by THE TRADE, who assumes full, complete and total legal responsibility for the products and / or services it sells, expressly accepting to exclude THE COMPANY and THE BANK, the legal personality of the same and the people who work or relate in any way to them, of any procedure, in any way and for any reason, of events consequent to the sale of products and / or services by EL COMERCIO.
THE COMPANY does not assume any responsibility for the fiscal and tax commitments of EL COMERCIO.
f) The Terms established herein and the conflicts that may arise regarding their interpretation, use, scope and termination are governed by the laws of the Republic of COLOMBIA. In the event that any provision of these Terms is or becomes invalid or unenforceable, it shall not affect the validity of the remaining provisions.
